These terms are an agreement between you and The Visionary Platform LTD ("GROW", "we", "us"). By creating an account or using the app, you agree to them. Please read them with our Privacy Policy and AI Usage Policy.

1. Eligibility
You must be at least 16 years old to use GROW. By using the app you confirm you are 16 or over and able to enter into these terms.
2. Your account
- Provide accurate information and keep your login details secure.
- You're responsible for activity under your account. Tell us promptly at [email protected] if you suspect unauthorised use.
- One person per account; don't impersonate others.
3. Acceptable use
You agree not to:
- Break the law, infringe others' rights, or post harmful, abusive, deceptive or offensive content.
- Upload content you don't have the right to share, or photos of people without their consent.
- Misuse the marketplace — e.g. list illegal, unsafe, prohibited or misrepresented items.
- Attempt to hack, overload, reverse-engineer, scrape or disrupt the app or its security.
- Use the app or its AI to generate unlawful, infringing or misleading material.
4. Your content
You keep ownership of the photos, notes and listings you add ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process and display Your Content only to operate and improve the app and provide the features you use (including sending it to AI providers to fulfil your requests). You're responsible for Your Content and confirm you have the rights to it. We may remove content that breaches these terms.
5. AI features & guidance
GROW uses AI to provide plant identification, soil and garden analysis, care suggestions, Sprout's chat, and Garden Studio redesigns and cost estimates. This output is automated guidance for general information only and may be inaccurate or incomplete. It is not professional horticultural, financial, structural, legal, medical or safety advice. Cost figures are rough estimates, not quotes.
Image-based analysis — including the plant, soil, garden and room scanners — may not accurately identify plants, diseases, pests, soil conditions or environmental factors. You should not rely solely on GROW when making decisions that could affect health, safety, food consumption, or significant expenditure. Always use your own judgement and seek a qualified professional where appropriate (for example before eating identified or foraged plants, using chemicals, or undertaking building work). 6. Gardening outcomes, food safety & products
Outcomes. GROW does not guarantee any particular gardening outcome, including plant survival, crop yield, harvest quantity, compost success, soil improvement, pest control, or garden transformation results. Gardening depends on many factors outside our control — including weather, environment, pests, and how guidance is interpreted and applied.
Food safety. GROW does not verify whether plants, produce, seeds or other gardening items are safe for consumption. You are responsible for confirming identification and food safety before eating, foraging or consuming anything. Never eat a plant, fruit, fungus or seed identified by the app without independent expert confirmation.
Products & chemicals. You are responsible for following manufacturer instructions and applicable laws when using compost, fertilisers, pesticides, chemicals, or soil amendments.
7. Marketplace
GROW's marketplace is a venue that connects gardeners who want to buy, sell, swap or give away produce, seeds, plants and similar items. Importantly:
- GROW is not a party to any transaction and does not process payments. Buyers and sellers arrange payment and collection/delivery directly between themselves.
- We do not guarantee the identity, reliability, reputation, quality, ownership, legality, or safety of marketplace users or listings.
- Sellers are responsible for the accuracy of listings, for the legality and safety of items (including food-safety and any sale of plants/seeds), and for meeting any consumer-law obligations that apply to them.
- Buyers should use sensible caution when meeting or transacting with others.
- Any dispute is strictly between the users involved. To the fullest extent permitted by law, GROW is not liable for marketplace transactions.
- Don't list prohibited, illegal, unsafe, recalled, counterfeit or restricted items.
8. Paid subscriptions
GROW offers optional paid features through a subscription ("GROW Premium").
- Pricing & billing. Current prices are shown at the point of purchase (for example £5.99/month or £56.99/year). On mobile, subscriptions are sold and billed through the Apple App Store or Google Play and are subject to those platforms' payment terms. On the web, payment is processed by our payment provider (Stripe). We do not control app-store billing processes.
- Free trial & automatic renewal. Where a free trial is offered, your subscription automatically renews at the price shown unless you cancel before the renewal date, and you will be charged through your chosen store or payment provider.
- Cancellation. You may cancel at any time through your account settings or the relevant app store (Apple and Google manage their own subscriptions). Cancelling stops future renewals; you keep access until the end of the period you've paid for. See our account & cancellation help.
- Refunds. Refunds for purchases made through the App Store or Google Play are handled by those platforms under their own policies — we do not control app-store refund decisions. For web purchases, contact [email protected].
- Price changes. We may change subscription prices. We'll give reasonable notice and any change applies from your next renewal. Your statutory rights as a consumer are not affected.
9. Our intellectual property
GROW, the Sprout character, our designs, software, text and branding are owned by The Visionary Platform LTD and protected by law. We grant you a limited, personal, non-transferable licence to use the app for its intended purpose. You may not copy, resell or create derivative works from it without our permission.
10. Third-party services
The app relies on third parties (e.g. Google, Cloudflare, Resend, Stripe, RevenueCat, weather data and your app store). Their services are governed by their own terms, and we're not responsible for them.
11. No warranty
The app is provided "as is" and "as available". We don't warrant that it will be uninterrupted, error-free, or that any guidance, identification or estimate will be accurate. Your statutory rights as a consumer are not affected.
12. Limitation of liability
Nothing in these terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or fraud). Subject to that, to the fullest extent permitted by law we are not liable for: indirect or consequential loss; loss of profit, data, crops, plants or goodwill; or losses arising from AI guidance, gardening outcomes, food safety, marketplace transactions, or your reliance on the app. Where we are found liable, our total liability is limited to the greater of the amount you paid us in the 12 months before the claim, or £50.
13. Indemnity
You agree to indemnify us against reasonable claims, losses and costs arising from your breach of these terms, your content, or your marketplace dealings.
14. Suspension & termination
You can stop using GROW and delete your account at any time (see how to delete your account). We may suspend or end your access if you breach these terms or to protect the app or other users. Sections that by their nature should survive (e.g. IP, liability, indemnity) continue after termination.
15. Changes to these terms
We may update these terms. We'll update the date above and, for material changes, notify you in the app or by email. Continuing to use GROW after changes means you accept them.
16. Governing law
These terms are governed by the laws of England & Wales, and the courts of England & Wales have jurisdiction, except that if you are a consumer resident elsewhere in the UK you may also bring proceedings in your home jurisdiction.
